Proffett ("we," "our," or "us") operates the Proffett mobile application and web platform (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use the App. By creating an account or using the App, you agree to the practices described in this policy.

a) Brokerage Partner — Alpaca Securities LLC

Your identity, financial, and account information is shared with Alpaca Securities LLC, our FINRA-registered broker-dealer partner, to open and operate your brokerage account. Alpaca's privacy practices are governed by their own privacy policy.

b) Bank Linking — Plaid Inc.

When you link a bank account, we use Plaid to verify your account and facilitate ACH transfers. Plaid receives your user ID to create a link token; your bank credentials are never shared with Proffett. Plaid's privacy policy applies to data processed on their platform.

c) Market Data — EODHD

We use EODHD for real-time and historical stock market data. Only stock symbol lookups are sent to EODHD. No personal data is shared.

d) Sign-In Providers — Google & Apple

If you choose Sign in with Google or Sign in with Apple, we receive a verified identity token (name and email) from those providers to create or authenticate your account. We do not receive your Google or Apple passwords. Your sign-in data is subject to Google's and Apple's respective privacy policies.

e) Identity Verification

During KYC onboarding, identity documents are processed by our third-party identity verification provider. Data is shared solely for the purpose of verifying your identity.

We use trusted third-party vendors for cloud hosting and customer support. These vendors are contractually prohibited from using your data for any purpose other than providing services to us.

The App is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected data from a minor, contact us at privacy@proffett.com and we will delete it promptly.

The App integrates with named third-party services (Alpaca, Plaid, EODHD, Google, Apple) as described in Section 4. We are not responsible for the privacy practices of those third parties beyond the scope of our agreements with them. We encourage you to review their privacy policies.

We may send push notifications for trade confirmations, account alerts, and price updates. You can disable push notifications at any time through your device's settings.

Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Proffett mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Proffett ("we," "our," or "us").

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

Proffett is a technology platform. Brokerage and custodial services are provided by Alpaca Securities LLC ("Alpaca"), a FINRA-registered broker-dealer and member of SIPC. Your brokerage account is held and maintained by Alpaca, not Proffett.

By opening a brokerage account through the App, you also agree to Alpaca's customer agreement and terms of service. In the event of a conflict between these Terms and Alpaca's terms regarding brokerage matters, Alpaca's terms govern.

SIPC protection covers securities held in your brokerage account up to $500,000 (including $250,000 for cash claims). SIPC does not protect against investment losses.

The App integrates with third-party services including Alpaca Securities LLC (brokerage), Plaid Inc. (bank linking), EODHD (market data), Google LLC, and Apple Inc. (sign-in). Your use of these services is subject to their respective terms and privacy policies. Proffett is not responsible for the availability, accuracy, or conduct of any third-party service.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROFFETT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR INVESTMENT LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify and hold harmless Proffett and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of your use of the App, violation of these Terms, or your investment decisions.

These Terms are governed by the laws of the State of Delaware. Any dispute shall be resolved by binding arbitration under AAA Consumer Arbitration Rules. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16. Account Termination

You may close your account at any time by contacting support@proffett.com. Upon closure, open orders will be cancelled, positions must be liquidated or transferred, and remaining cash will be returned to your linked bank account.

Payment for Order Flow (PFOF) Disclosure

Effective Date: March 29, 2026

1. What is Payment for Order Flow?

Payment for Order Flow (PFOF) is a practice by which a broker-dealer receives compensation from a market maker or other trading venue in exchange for routing customer orders to that venue for execution.

Proffett's brokerage services are provided through Alpaca Securities LLC, a FINRA-registered broker-dealer (Member FINRA/SIPC). Alpaca may receive payment for order flow in connection with orders placed through the Proffett platform.

Alpaca Securities LLC is required under FINRA Rule 5310 to use reasonable diligence to obtain the best available price for your orders under prevailing market conditions. This obligation applies regardless of whether PFOF is received. Proffett does not influence Alpaca's order routing decisions.

4. SEC Rule 606 Reports

Alpaca publishes quarterly order routing reports under SEC Rule 606, disclosing material aspects of its PFOF arrangements. These reports are available at alpaca.markets/disclosures. You may request a copy for any month in the prior 6-month period by contacting support@proffett.com.

5. No Conflict of Interest

Proffett has no financial interest in Alpaca's routing decisions and receives no compensation based on where your orders are routed. Proffett's revenue comes from premium subscriptions, interest on uninvested cash, and the TRIO marketplace — none of which creates an incentive to influence order routing.
